SAFE WORK METHOD STATEMENTS (SWMS)

What Is a SWMS?

A Safe Work Method Statement (SWMS) is a legal document required under Australian Work Health and Safety (WHS) legislation for any High Risk Construction Work (HRCW). It identifies the work activity to be carried out, the hazards that arise from that activity, and the measures to be put in place to control those hazards before, during, and after the work.

In Victoria, the equivalent legislation is the Occupational Health and Safety Act 2004 and associated Regulations. In all other states and territories (except Victoria), the Work Health and Safety Act 2011 applies. Despite minor differences in state legislation, the fundamental requirement for a SWMS is consistent across the country: if you're doing high risk construction work, you need one before you start.

Legal Definition — High Risk Construction Work

Under Australian WHS legislation, High Risk Construction Work includes work that involves: a risk of a person falling more than 2 metres; work on a telecommunications tower; demolition; work involving structural alterations that require temporary support; work near energised electrical installations or services; work in confined spaces; work involving explosives; work involving powered mobile plant; work on or near pressurised gas mains or piping; work on, in, or adjacent to a road, railway, or shipping lane; work in an area with a contaminated or flammable atmosphere; and tilt-up or precast concrete work.

When Do You NEED a SWMS?

You are legally required to have a SWMS before commencing any High Risk Construction Work (HRCW). This is not optional. The document must be prepared before work starts — not during or after. It must be:

Principal contractors on commercial sites will almost always require a SWMS from every subcontractor before allowing them access to site. Even for work that may technically fall below the HRCW threshold, having a SWMS demonstrates professionalism and protects you legally if anything goes wrong.

What Must a SWMS Include?

Under Australian regulations, a legally compliant SWMS must identify and document the following:

In practice, professional SWMS documents used on commercial sites also include: company and project details, state-specific legislation references, PPE requirements, skills and licences needed, tools and equipment, hazardous substances, site-specific risk assessment, site safety rules, an emergency plan, and a worker sign-off section.

The Hierarchy of Controls

A critical component of any compliant SWMS is applying the Hierarchy of Controls — the preferred order in which hazard controls should be applied. The hierarchy requires you to consider elimination first, before moving down the list only if the higher-level control is not reasonably practicable:

Risk Rating — AS/NZS 4360

The risk matrix used in a compliant SWMS is based on AS/NZS 4360 — the Australian/New Zealand Standard for Risk Management. Risks are assessed on two dimensions: Likelihood (how likely is the event to occur) and Consequence (how severe would the outcome be). The combination produces a risk rating:

E — Extreme Risk
H — High Risk
M — Moderate Risk
L — Low Risk

Each hazard in the SWMS is assigned an initial risk rating before controls are applied, and a residual risk rating after controls are applied. The goal is to reduce all risks to the lowest practicable level.

Penalties for Not Having a SWMS

Failure to have a compliant SWMS when required is a breach of WHS legislation and carries significant penalties. Under the WHS Act, penalties for individuals can reach $50,000 per offence, and for corporations, up to $500,000. In cases involving recklessness or gross negligence, criminal charges and imprisonment are possible under Category 1 offences. Beyond the regulatory penalties, working without a SWMS exposes you to unlimited personal civil liability if a worker or third party is injured on site.

By accessing or using the ComplianceAI platform at complianceai.com.au (the "Platform"), creating an account, using our document generation tools, or by clicking any button, checkbox, or link indicating acceptance, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms," "Agreement"). These Terms constitute a binding legal agreement between you and ComplianceAI, a business operated in the State of Victoria, Australia ("ComplianceAI," "we," "us," or "our"). If you are using the Platform on behalf of a business, company, trust, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" shall refer to that entity. If you do not agree with all of these Terms, you must immediately discontinue all use of the Platform. We reserve the right to update or modify these Terms at any time without prior individual notice. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms. The date of the most recent revision is indicated at the top of this document. We encourage you to review these Terms periodically.

ComplianceAI is a document generation technology platform. The Platform provides tools that allow users to input information and generate template documents including, but not limited to, Safe Work Method Statements ("SWMS") and other compliance-related documents (collectively, "Generated Documents"). The Platform is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Platform, the information, content, or materials included on the Platform, or the accuracy, completeness, suitability, or currency of any Generated Document. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, virus-free, or free of other harmful components, or that defects will be corrected. We do not warrant that the results obtained from the use of the Platform will be accurate, reliable, complete, or meet your requirements or the requirements of any third party, regulator, or government authority.

The Platform is a document generation tool only. Nothing contained within the Platform, in any Generated Document, in any communication from ComplianceAI, or in any material produced or accessible through the Platform constitutes, or should be construed as, legal advice, safety advice, engineering advice, accounting advice, taxation advice, financial advice, or any other form of professional advisory service. No solicitor-client, accountant-client, safety consultant-client, or any other professional advisory relationship is created between you and ComplianceAI by your use of the Platform, by your acceptance of these Terms, or by any other means. The information provided by the Platform is general in nature and does not take into account your specific circumstances, site conditions, business structure, regulatory obligations, or any other individual factors. You should always seek the advice of appropriately qualified and licensed professionals before relying on any Generated Document, including but not limited to registered safety consultants, licensed WHS advisors, registered tax agents, qualified accountants, and legal practitioners admitted to practice in the relevant jurisdiction. The inclusion of references to legislation, regulations, codes of practice, or Australian Standards within Generated Documents does not constitute legal advice and should not be relied upon as such.

You are solely and entirely responsible for: ensuring that all information you enter into the Platform is accurate, current, complete, and not misleading; verifying that all Generated Documents comply with all applicable Work Health and Safety legislation, regulations, codes of practice, safe work instruments, and the specific requirements of the relevant principal contractor, site owner, regulatory authority, and any other applicable party before any Generated Document is used, shared, or relied upon in any way; engaging a competent person as defined under applicable WHS legislation to review, verify, and approve all Generated SWMS documents before those documents are brought onto any worksite or relied upon in connection with any work activity; identifying all site-specific, project-specific, and activity-specific hazards that may not be captured within a Generated Document, and taking all necessary action to address those hazards; ensuring that all workers who are required to comply with or sign a Generated SWMS are properly inducted into the content of that document, have been given a genuine opportunity to contribute to the identification of hazards and the formulation of control measures, and understand their obligations under the document before commencing any work activity; reviewing, updating, and revising Generated SWMS documents whenever the nature of the work changes, the site conditions change, the identified control measures are found to be inadequate or inappropriate, or a worker requests a review; retaining copies of all Generated Documents in accordance with applicable legislative requirements, including the requirement under Australian WHS legislation to retain SWMS documents for a minimum of two years after the completion of the relevant work activity; ensuring that you hold all licences, registrations, certifications, and other authorisations required by applicable law to perform the work described in any Generated Document and to use or rely upon the Platform in the manner in which you use it.

To the maximum extent permitted by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) and all other applicable legislation, ComplianceAI, its operators, directors, shareholders, officers, employees, contractors, agents, licensors, successors, and assigns (collectively, "ComplianceAI Parties") expressly exclude all liability for any loss, damage, cost, claim, demand, liability, or expense of any kind whatsoever, whether arising in contract, tort (including negligence), statute, equity, or otherwise, including but not limited to: any personal injury, serious injury, disability, or death occurring to any person in connection with any work activity to which a Generated Document relates; any property damage, destruction of property, or loss of property occurring in connection with any work activity to which a Generated Document relates; any infringement notices, improvement notices, prohibition notices, enforceable undertakings, regulatory investigations, prosecutions, convictions, fines, penalties, or other regulatory action taken against you by WorkSafe Victoria, SafeWork NSW, Workplace Health and Safety Queensland, the Department of Energy, Mines, Industry Regulation and Safety of Western Australia, SafeWork SA, WorkSafe Tasmania, the Australian Capital Territory Work Safety Commissioner, NT WorkSafe, or any other government, regulatory, or enforcement body; any ATO audit, ATO investigation, tax shortfall assessment, additional tax, interest on unpaid tax, administrative penalties, criminal penalties, or any other action taken by the Australian Taxation Office or any other taxation authority in connection with your tax obligations; any rejection, non-acceptance, or challenge to a Generated Document by any principal contractor, client, project owner, superintendent, site supervisor, regulatory authority, court, tribunal, or other party; any failure by a Generated Document to comply with the requirements of applicable legislation, regulations, codes of practice, industry standards, or the specific requirements of any principal contractor or regulatory authority; any financial loss, loss of income, loss of opportunity, loss of profit, loss of revenue, loss of goodwill, or loss of contract howsoever arising; and any direct, indirect, incidental, special, consequential, exemplary, aggravated, or punitive damages of any kind and howsoever arising. Where legislation implies conditions or warranties that cannot be excluded, our liability is limited, to the fullest extent permitted by law, to the resupply of the relevant service or the cost of having the relevant service resupplied, as we may elect.

You agree to fully and unconditionally indemnify, defend, and hold harmless the ComplianceAI Parties from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, judgments, costs, and expenses (including reasonable legal fees and disbursements on a full indemnity basis) arising from or in any way related to: your use of or access to the Platform, including any use that violates these Terms; any Generated Document created through your use of the Platform, including the use, reliance upon, distribution, or implementation of that document by you or any other person; your breach of any representation, warranty, obligation, or term contained in these Terms; any claim by any third party, including but not limited to workers, subcontractors, principal contractors, site owners, members of the public, or government authorities, arising from or related to any work activity to which a Generated Document relates or any compliance failure to which a Generated Document relates; any inaccuracy, incompleteness, or error in the information you provided to the Platform; and any infringement or alleged infringement of any intellectual property right, privacy right, or other right of any third party arising from your use of the Platform or any Generated Document.

The Platform, including all software, code, algorithms, databases, content, design elements, trademarks, trade names, logos, and other materials that form part of the Platform, are the exclusive intellectual property of ComplianceAI and its licensors. All rights are reserved. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for the purpose of generating documents for your own legitimate business use, subject to and conditional upon your compliance with these Terms. You must not reproduce, copy, sell, resell, sublicence, assign, distribute, publish, broadcast, transmit, or otherwise exploit the Platform or any part of it for any purpose without our prior written consent. You must not reverse engineer, decompile, disassemble, or attempt to derive the source code of any software forming part of the Platform. You must not use the Platform in any manner that could damage, disable, overburden, or impair our servers or networks. All Generated Documents, once produced, are owned by you to the extent of the content you provided, but we retain all intellectual property rights in the underlying templates, algorithms, structure, and technology used to produce those documents.

Certain subscription plans include a free trial period as described on the Platform. The free trial is a one-time offer tied to a single user account and a single email address and cannot be transferred, shared, gifted, duplicated, or circumvented in any way. Any attempt to create multiple accounts for the purpose of obtaining additional Free Trial documents — including but not limited to creating accounts under different email addresses, using disposable email addresses, or using another person's details — constitutes a material breach of these Terms and may result in the permanent suspension of all associated accounts without notice. We reserve the right to modify, restrict, suspend, or terminate the Free Trial offer at any time and without prior notice. Any credits, entitlements, or benefits associated with a Free Trial account are non-refundable, non-transferable, and of no monetary value. Additional document generation beyond the Free Trial is subject to applicable fees as published on the Platform from time to time. All fees are in Australian dollars and inclusive of GST where applicable.

Partners who sign up to our referral program ("Partners") do so voluntarily and in accordance with these Terms and any additional partner program terms communicated to them at the time of sign-up. Partners receive a unique referral link that may be shared with other potential users of the Platform. Commission rates, payment thresholds, payment schedules, and eligible referral activities are as determined by ComplianceAI from time to time and may be amended with or without prior notice. ComplianceAI reserves the right to withhold, suspend, or reverse commission payments in cases where referrals are found to be fraudulent, ineligible, or otherwise in breach of these Terms or the partner program terms. Referral links must not be used in conjunction with unsolicited commercial electronic messages (spam) as defined under the Spam Act 2003 (Cth), misleading or deceptive advertising, paid search advertising that implies an official association with any principal contractor, regulatory body, or government authority, or any other activity that ComplianceAI determines to be contrary to the best interests of the Platform or its users. ComplianceAI reserves the right to terminate any Partner's participation in the referral program at any time, for any reason, with or without notice, and without liability to the Partner. Upon termination, any unpaid commissions that have not yet reached the payment threshold will be forfeited.

In collecting and using personal information provided by you in connection with your use of the Platform, ComplianceAI acts in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles contained within that Act. The personal information we collect, including your name, email address, business name, ABN, and other business details, is used for the purposes of operating the Platform, generating your requested documents, administering your account, communicating with you about your account or our services, and improving the Platform. We do not sell your personal information to third parties. We may share your information with trusted third-party service providers who assist us in operating the Platform, subject to appropriate confidentiality and data protection obligations. By using the Platform, you consent to the collection and use of your information as described in these Terms and in our Privacy Policy, which forms part of this Agreement. You have the right to access, correct, or request deletion of your personal information, subject to applicable legal requirements, by contacting us at privacy@complianceai.com.au.

These Terms and any dispute or claim arising out of or in connection with them, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law principles. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Victoria for the resolution of any dispute arising from or relating to these Terms or your use of the Platform. Before commencing any formal legal proceeding, the parties agree to attempt to resolve any dispute through good faith negotiation for a period of thirty (30) days from the date on which one party notifies the other of the dispute. If the dispute cannot be resolved through negotiation within that period, either party may refer the dispute to mediation before a mediator to be agreed between the parties, or failing agreement, appointed by the Resolution Institute. The costs of mediation shall be shared equally between the parties unless the mediator otherwise determines. Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms, and the remaining provisions of these Terms shall continue in full force and effect. Any failure by ComplianceAI to enforce any provision of these Terms shall not be construed as a waiver of our right to enforce that provision at a future time or to enforce any other provision of these Terms. These Terms constitute the entire agreement between you and ComplianceAI with respect to your use of the Platform and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral, relating to the subject matter of these Terms. These Terms are not assignable by you without our prior written consent but may be assigned by us to any successor entity or acquirer of all or substantially all of our business or assets without restriction.
